These are the terms on which the Verandah consumer brands (Verandah Retail, TileCloud, Yabby and Dawn) sell to you. By using our websites or placing an order, you agree to these terms. Verandah Trade has its own separate terms, which these do not replace.
1. Who you are dealing with
1.1 These terms apply when you buy from, or use the websites or showroom of, the Verandah consumer brands: Verandah Retail, TileCloud, Yabby and Dawn. Each brand is operated by a company in the Verandah Brands Group.
1.2 The operating companies are TileCloud Pty Ltd (ABN 57 686 206 566), Yabby Bathware Pty Ltd (ABN 83 644 161 991), Dawn Lighting Pty Ltd (ABN 51 686 206 539) and Verandah Retail Pty Ltd (ACN 698 757 701; ABN 92 698 757 701). Each is a related body corporate (as defined in section 9 of the Corporations Act 2001 (Cth)) of Verandah Brands Pty Ltd (ABN 42 658 475 355). In these terms, “we”, “us” and “our” mean the company operating the brand you are dealing with and, where these terms say so, the other companies in the group.
1.3 When you place an order with a brand, your contract of sale is with the company that operates that brand. Any brand-specific terms, for example delivery or returns details, apply together with these terms.
1.4 You can reach us through the contact page on each brand’s website. Our registered office is 34 Rosebery Avenue, Rosebery NSW 2018.
2. Your Verandah account
2.1 You can create an account to shop with us. As the Verandah brands come together we are moving to a single customer account and profile that works across the group, so you do not need separate logins for each brand. You are responsible for keeping your login details secure and for activity under your account.
2.2 If you already have an account or order history with one of our brands, we may create a Verandah customer profile for you and link your existing records to it. We use identifiers such as your email address and mobile number to match records that belong to the same person, so your history stays connected and you are not set up twice.
2.3 Creating or linking a profile does not change your marketing preferences. How we contact you for marketing is dealt with in section 8, and your existing choices carry over unless you change them.
2.4 You must be at least the age of majority in your State or Territory to buy from us or hold an account.
3. Orders, pricing and payment
3.1 Prices are shown in Australian dollars and include GST unless stated otherwise. Prices and product details can change at any time without notice.
3.2 We accept Visa, Mastercard and American Express, and at online checkout Apple Pay, Google Pay, PayPal, Shop Pay, Afterpay and other buy-now-pay-later options. We do not accept cash in our showroom. Payment is taken when you place your order; if payment fails or is invalid, your order is not accepted and we will let you know.
3.3 We may refuse or cancel an order, and may limit or cancel quantities purchased per person, per household or per order, including where we believe an order is placed by a reseller. If we cancel an order you have paid for, we refund you.
3.4 We try to keep pricing and product information accurate, but errors can occur. We may correct errors and cancel any affected orders, including after you have placed an order, and refund you if you have paid.
4. Delivery and click & collect
4.1 We use reasonable efforts to meet estimated delivery times (for example, TileCloud tile orders are estimated at around 12 business days), but delivery times are estimates and are not guaranteed.
4.2 Where goods are delivered by our nominated couriers (for example tiles delivered on pallets), delivery is kerbside to the address you give us. Once goods are delivered to that address, they become your responsibility.
4.3 Please inspect your delivery on arrival. Claims for damage, shortages, incorrect items or invoice discrepancies must be made within two (2) business days of delivery, with supporting photographs. If a redelivery is needed because delivery could not be completed, we may charge the redelivery cost.
4.4 Click & collect: we hold your order for up to 10 days after we tell you it is ready. After that, a storage fee may apply (for tile orders, $10 per order per day).
5. Returns, refunds and change of mind
5.1 If you change your mind, you can return unused items in their original packaging and in saleable condition within 30 days of delivery, with these variations: tile returns are within 30 days but a 5% restocking fee applies; and tapware, bathware and under-floor heating can be returned within 60 days. For change-of-mind returns you arrange and pay return shipping unless we tell you otherwise, and refunds exclude the original shipping cost.
5.2 Once a product has been installed or fixed, it is treated as accepted and cannot be returned for change of mind. We are not responsible for installation or removal costs.
5.3 If an item is faulty, damaged in transit or incorrectly supplied, contact us within the timeframe in clause 4.3 and we will arrange the return and a replacement or refund at no return-shipping cost to you. Returns require proof of purchase.
5.4 Nothing in these terms limits your rights under the Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under that law, including for major failures. This returns section applies in addition to those rights.
6. Product information and samples
6.1 We make every effort to show colours and images accurately, but we cannot guarantee that your screen displays colours accurately. Please check your order (dimensions, colours, shade variation, quantity and finish) before you buy and before you install.
6.2 Tiles are quoted in their nominal (approximate) size. As an industry standard, actual size can vary by plus or minus 2mm, and wall and floor tiles of the same nominal size may not line up exactly.
6.3 Samples: TileCloud offers 5 samples for $15. The $15 is refundable once you make a full purchase, using a refund code we email you; the offer is redeemable once per customer and the code is valid for 6 months from the sample order date.
7. Discount codes and promotions
7.1 From time to time we offer discount codes, including through partner programs. Unless a code’s own terms say otherwise: one code applies per order and codes cannot be combined with each other or with any other offer; codes apply to full-price items only; codes have no cash value and cannot be applied to past orders; codes do not apply to delivery charges or gift cards; a one-time-use code can be used once per customer; and we may change, withdraw or expire a code at any time.
7.2 Partner programs. We run partner programs, including with Three Birds Renovations (Reno School, Dream Discount and Fourth Bird). Eligible participants receive a discount code from us or through the program. These codes give a set discount on full-price orders and, unless stated otherwise, exclude vanities and under-floor heating. They are subject to the rules in clause 7.1 and to the terms of the relevant program, and apply on the relevant brand’s website and on Verandah Retail.
7.3 Other offers. YABBY10: 10% off tapware when you buy tiles and tapware together (TileCloud). VERANDAH10: 10% off your order when you buy from two or more brands, one use per customer (Verandah Retail only).
7.4 We may also run promotions from time to time. Where we do, the specific terms of that promotion will be published with it and will apply to it.
8. Marketing communications and your consent
8.1 We will send you messages we need to send to operate your account and complete your orders, for example order confirmations, delivery and click & collect updates, account and security notices, and notices about changes to these terms or our Privacy Policy. These are not marketing messages and you receive them regardless of your marketing preferences.
8.2 We will only send you marketing by email or SMS if you have consented. You can consent when you create an account, at checkout, or by subscribing, and you can withdraw consent at any time.
8.3 Marketing across the Verandah consumer brands. When you consent you can choose to hear from a single brand or from the Verandah consumer brands as a group: TileCloud, Yabby, Dawn and Verandah Retail. If you choose the group option you may receive marketing about any of those brands. This is a choice you make; it is not switched on automatically, and you can change it or opt out at any time.
8.4 Verandah Trade. Verandah Trade serves trade professionals and has its own separate marketing opt-in. Consenting to consumer marketing does not sign you up to Verandah Trade marketing, and the reverse also applies.
8.5 Opting out. Every marketing email has an unsubscribe link and you can reply STOP to any marketing SMS. We action opt-outs within 5 business days. Opting out of marketing does not stop the service messages in clause 8.1.
9. Your information and privacy
9.1 We handle your personal information in line with our Privacy Policy, available on our website, which forms part of these terms and explains what we collect, how we use it, how we share it across the Verandah Brands Group, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
9.2 Because our brands are related bodies corporate, we share your personal information among Verandah group companies so we can operate your account and serve you across brands, and with service providers who help us run our business (for example payment, delivery, IT and email or SMS platforms). Those providers may use your information only to provide their services to us.
10. Using our websites
10.1 We try to keep information on our sites accurate and current, but we do not warrant that it is free of errors or always up to date, and you should not rely on it as the only basis for a decision. Any tools or third-party links we make available are provided “as is”, and we are not responsible for third-party content or sites.
10.2 If you send us comments, reviews or other submissions, you agree we may use, edit and publish them, and you are responsible for what you submit. We may remove content that is unlawful or offensive.
10.3 You must not use our sites or products for any unlawful or prohibited purpose, infringe our or others’ intellectual property, introduce malware, or interfere with the security or operation of our sites. The content of our sites is owned by us or our licensors and may not be copied or resold without our written permission.
11. Liability, indemnity and the Australian Consumer Law
11.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term, that the law says we cannot exclude or limit.
11.2 Subject to clause 11.1, and to the extent the law allows, our services and products are provided on an “as is” and “as available” basis, we are not liable for indirect or consequential loss, and our liability is limited (at our option) to resupplying the goods or services or paying the cost of doing so.
11.3 Subject to clause 11.1, you agree to indemnify us against claims arising from your breach of these terms or your misuse of our sites or products, to the extent the loss was caused by you.
12. Changes to these terms
12.1 We may update these terms from time to time. Where a change is significant we will take reasonable steps to tell you before it takes effect, for example by email or a notice on the site, and we will show the current version and the date it was last updated on our sites.
12.2 We will not treat a change to these terms as creating marketing consent you have not actively given. Your marketing consent is dealt with in section 8 and is always yours to give or withdraw.
13. General
13.1 If any part of these terms is found to be invalid or unenforceable, that part is severed and the rest continues to apply.
13.2 These terms, together with the Privacy Policy and any brand-specific terms, are the entire agreement between you and us about their subject matter.
13.3 These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.

14. Definitions
Verandah Brands Group means Verandah Brands Pty Ltd and its related bodies corporate.
Verandah consumer brands means TileCloud, Yabby, Dawn and Verandah Retail; the brands these terms and the consumer marketing group in clause 8.3 apply to. Verandah Trade is not a Verandah consumer brand for these purposes.
Related bodies corporate has the meaning given in section 9 of the Corporations Act 2001 (Cth).
Marketing message means a commercial electronic message (email or SMS) whose purpose, or one of whose purposes, is to promote or advertise goods, services, brands or offers, as described in the Spam Act 2003 (Cth).
Service message means a message sent to operate your account or complete your order that consists only of factual information and has no marketing purpose.
